Red White and Booked LLC (“Red White and Booked,” “we,” “us,” or “our”) operates redwhiteandbooked.com and provides customer communication software to local service businesses. This policy explains what information we collect, how we use it, and the choices you have.

1. Who this policy covers

This policy applies to two groups:

• Our customers — the businesses that subscribe to our service.
• Website visitors — anyone who visits redwhiteandbooked.com.

If you are a customer of one of our customers (for example, you received a text message from a plumbing company that uses our software), that business controls your information and its own privacy policy governs how your data is used. We process that information on their behalf. See Section 6.

2. Information we collect

Information you give us directly:

• Name, business name, email address, phone number, and mailing address
• Business information required for carrier registration, including your legal entity name and tax identification number
• Billing information (payment card details are collected and stored by our payment processor, not by us)
• Any information you send us in an email or support request

Information collected automatically when you visit our website:

• IP address, browser type, device type, and operating system
• Pages viewed, time spent, and referring website
• Cookies and similar technologies (see Section 7)

Information we process on behalf of our customers:

When a business uses our software, we process contact records, appointment details, call records, and message content belonging to that business and its customers.

3. How we use information

We use information to:

• Provide, operate, and maintain the service
• Set up and configure your account, including registering your business with mobile carriers as required for business text messaging
• Process payments and send billing notices
• Respond to support requests
• Send service-related notices such as outages, changes to terms, or security alerts
• Send marketing communications about our services, where permitted by law and subject to your ability to opt out
• Detect, investigate, and prevent fraud, abuse, and violations of our Terms of Service
• Comply with legal obligations

4. How we share information

We do not sell personal information. We do not share personal information with third parties for their own marketing purposes.

We share information only with:

• Service providers who help us operate the business — including our software platform provider, telecommunications and messaging providers, payment processor, and email provider — and only to the extent needed to perform those services.
• Mobile carriers and The Campaign Registry, as required to register your business for application-to-person text messaging. This is a mandatory requirement for business texting in the United States.
• Legal and safety recipients, when required by law, subpoena, or court order, or where we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
• A successor entity, in connection with a merger, acquisition, financing, or sale of all or substantially all of our assets. We will notify you of any such change in ownership.

5. Data retention

We retain personal information for as long as your account is active and for a reasonable period afterward to comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. You may request deletion of your account data as described in Section 8.

6. Information belonging to our customers' customers

When a business uses our software to communicate with its own customers, that business is the controller of that information and we act as a processor on its behalf. We use that information only to provide the service and as directed by that business. If you received a message from a business using our platform and want your information removed, contact that business directly. You may also reply STOP to any text message to stop receiving messages.

7. Cookies

Our website uses cookies and similar technologies to operate the site, remember your preferences, and understand how the site is used. Most browsers let you refuse or delete cookies. Doing so may affect how parts of the site function.

8. Text messaging (SMS)

How we collect SMS consent. We collect your mobile phone number and your consent to receive text messages only when you provide them directly — by checking an unchecked consent box on one of our web forms, or by texting us first. Consent is never a condition of purchase, and we never add a number to a messaging program without an affirmative opt-in. What we send. If you opt in to transactional messages, we send missed-call auto-replies, appointment confirmations, appointment reminders, and booking or account updates. If you separately opt in to marketing messages, we send promotional offers, discounts, seasonal and event announcements, and review requests. Message frequency varies. Rates. Message and data rates may apply. Your mobile carrier's standard charges apply to messages you send and receive. How to stop. Reply STOP to any message to opt out, or HELP for assistance. You may also email [email protected] with your phone number and a request to be removed. How we handle the data. Mobile phone numbers and SMS consent records are used only to deliver the messaging described above, and are retained as proof of consent for as long as carrier and legal recordkeeping rules require. No sharing. Text messaging consent is never shared. We do not share or sell mobile phone numbers or SMS consent data with third parties or affiliates for marketing purposes. Numbers are disclosed only to the messaging providers that transmit messages on our behalf and to mobile carriers as required to deliver them. Full details are in our SMS Terms.

9. Your choices and rights

Marketing emails: You can unsubscribe using the link in any marketing email.

Text messages: Reply STOP to any text message from us to opt out. Reply HELP for assistance.

Access, correction, and deletion: You may request a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it. Email [email protected] and we will respond within the time required by applicable law.

State privacy rights: Depending on where you live, you may have additional rights under state law, including the right to know what personal information we collect and the right to opt out of certain processing. We do not sell personal information or share it for cross-context behavioral advertising.

10. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Children

Our service is intended for businesses and is not directed to children under 16. We do not knowingly collect personal information from children under 16.

12. Changes to this policy

We may update this policy from time to time. When we do, we will revise the effective date above. If the changes are material, we will notify you by email or through the service.
